Company MBC, (Further - "Company") offers the user (hereinafter referred to as "User") service for searching advertisements for the sale of apartments, houses and other real estate on the website mbclawproperties.com (Further - "Service") subject to the terms of use set forth in this document (hereinafter referred to as "Conditions").
1. Acceptance of terms and conditions
1.1. By starting to use the Service, the User expresses his full and unconditional agreement with all the requirements set forth in the Terms. Your use of the Service is subject to these Terms, which constitute a legally binding agreement (“ "Agreement"), concluded between the User and the Company.
1.2. Use of the Service on terms other than those provided for in this document is not permitted without the written permission of the Company. If the User does not agree with any of the conclusions of the Terms, he must immediately stop using the Service. The Company reserves the right, in its sole discretion and at any time, to amend or change the provisions of these Terms. 1.3. The User represents and warrants that he has full legal capacity necessary to use the Service in accordance with the Terms; and also confirms that he has read the Terms, understands and agrees to comply with their requirements. By accessing or using the Service, or otherwise indicating User's agreement to these Terms, whenever such an option is provided to User: (a) User acknowledges that he has read and understands the contents of the most current version of the Terms; (b) the User confirms that he is of legal age to enter into a legally binding agreement with the Company; (c) the User accepts the Terms and agrees that he is legally bound by the Terms; (d) the User agrees that the Terms will be deemed to satisfy any requirement under applicable law that the agreement between the User and the Company be in writing; and; (e) User agrees that User's actions to register or log into the Service, or otherwise indicate User's agreement to the Terms, will be deemed to be User's valid certified signature for purposes of any applicable law requiring that the Terms between the User and the Company be signed by the User in writing.
2. Provision of Service
2.1. The Service offers the User the opportunity to search and select advertisements for the sale of apartments, houses and other real estate. All currently existing functions of the Service, as well as any changes thereto and/or addition of new functions, are subject to these Terms.
2.2. Advertisements and other information provided by the Company’s partners (hereinafter referred to as the “Partner” or “Partners”) may be uploaded and published on the Service by the Company by agreement with the Partners.
2.3. The information about the property specified in the advertisement is for reference only. The company does not guarantee the accuracy, relevance, or reliability of this information. When using information about a property, you must pay attention to information about the date of its last update (if available).
2.4. Information about exchange rates in advertisements is provided for informational purposes only. The company does not guarantee the accuracy of the displayed exchange rates and their compliance with the conversion rate when making a transaction. Before carrying out transactions involving currency conversion, it is necessary to check the exchange rate from official sources.
2.5. To protect the contact information of the person who posted the advertisement from being used by an unknown number of persons for purposes unrelated to the use of the Service, the Company may use the function of replacing the number posted by the User in the Service. The Company may record and store a conversation between Users made on a call using such a substitute number, as well as the contact information specified in the Service and the User’s telephone number from which the call was made for processing under the terms of this Agreement.
2.6. By posting contact information in the Service, as well as initiating communication using the specified data, the User expresses his consent to the Company to record the conversation and the phone number from which the call was made, the use of call data in order to identify the likelihood of the User completing a transaction using the information posted in the Service, preservation of text communication as well as the transfer of data to the Company’s partner, who provides the technical capabilities to implement this function and to the person receiving the User’s call for feedback from the User.
2.7. The Company may provide assistance to the User in selecting real estate, including by providing relevant information based on the information received from the User and the parameters specified by him. Interaction with the User can be carried out through Service support operators during a telephone conversation with the User, or by providing the User with contact information of the Company’s partner.
2.8. For these purposes, the Company, with the consent of the User, may forward the User’s call to a Company partner. When forwarding a call, the Company may use the number substitution function under the conditions specified in clause 2.4. of these Terms.
2.9. By transferring information during a conversation with a support service operator, as well as sending a request by filling out a form in the Service (if such a form is provided), the User expresses the Company’s consent to the processing of the personal information provided by him in accordance with these Terms, including the transfer of received information to the Company’s partner in order to provide feedback on the acquisition of real estate.
3. Intellectual property
3.1. The exclusive right to the Service belongs to the Company. These Terms do not grant Users any rights to use the Service, other than those provided directly in the Service interface in accordance with the provisions of these Terms. 3.2. Any information used in the Service is intended solely for personal, non-commercial use. Moreover, any copying of Service data, including using automatic and other software tools for gaining access to data, their reproduction, processing, distribution, making available to the public (publication) on the Internet, any use in the media and/or for commercial purposes without the prior written permission of the copyright holder is prohibited, except as expressly provided for in these Terms.
4. Limitation of Liability.
4.1. The service is provided on an “as is” basis. The Company does not provide any guarantees regarding the error-free and uninterrupted operation of the Service or its individual components and/or functions, the suitability of the Service for the specific purposes of the User, and does not provide any other guarantees not expressly stated in these Terms.
4.3. Any disputes, questions, claims and lawsuits related to the content, form, distribution, or other use of information provided by the Partners should be addressed to the Service Partners who are the owners of the relevant information. Information about Partners may be indicated in advertisements, as well as on the Partners’ websites on the Internet.
4.4. The Company is not responsible for any direct or indirect consequences of any use or inability to use the Service and/or losses caused to the User and/or third parties as a result of any use, non-use or inability to use the Service or its individual components and/ or functions, including due to possible errors or failures in their operation, except as expressly provided by law.
4.5. The Company reserves the right, at its sole discretion, to limit the User’s access to the Service (or to certain functions of the Service, if technologically possible) using his account or to completely block the User’s account without specifying any reason, including in case of repeated or gross violation of these Terms. , Agreement or Regulatory Documents, or apply other measures to the User in order to comply with legal requirements or the rights and legitimate interests of third parties.
5. Other provisions
